Why is Israel portrayed as being virtually above international law?

The phenomenon of Israel's supporters and official state communications trying to remove it from certain international legal mechanisms – to position it as „above international law” – is not accidental. It is a consciously constructed strategy, relying on legal, political and moral arguments.

This approach is fundamentally based on four pillars:

1. Sovereignty and non-member state status (The legal argument)

It is a fundamental principle of international law that international treaties and courts are binding only on those states that have voluntarily signed and ratified them.

* Israel (like the United States, Russia or China) **is not a party to the Rome Statute establishing the International Criminal Court (ICC)**.

* The official argument is that since Israel has never relinquished jurisdiction to an external court, The Hague simply **has no legal basis** to hold Israeli citizens or leaders accountable. This is presented as a defense of sovereignty, not an abuse of the law.

2. The principle of complementarity and independent judiciary

International courts (especially the ICC) operate on the principle of **complementarity**. This means that the international body can only intervene if a country's own judiciary is (*unable*) or (*unwilling*) to investigate war crimes.

* According to the Israeli narrative, Israel is a functioning, independent, Western-style democracy with its own strong and critical Supreme Court and military prosecutor's office.

* This logic argues that external intervention is unnecessary and offensive because the Israeli legal system itself is capable of investigating abuses. Critics, on the other hand, point out that systemic, state-directed policies (such as the blockade or settlement construction) will never be considered war crimes by Israeli courts.

3. Asymmetric warfare and existential threat (The moral argument)

The most common moral justification for hasbara and Israeli diplomacy is to appeal to the uniqueness of the situation. They argue that traditional international law (e.g. the Geneva Conventions) was designed for wars between regular armies, not for asymmetric conflicts where a state fights a non-state terrorist organization (e.g. Hamas, Hezbollah) hiding behind a civilian population.

The narrative is that the mechanical application of international law would tie the hands of defensive democracies while giving an advantage to rule-abiding terrorists. As a result, military necessity and national survival are often prioritized over rigid legal norms.

4. Bias of the UN and international forums (Delegitimization)

To deflect criticism from international organizations, Israeli communications systematically label them as biased and politically motivated.

* The UN Human Rights Council (UNHRC) is often cited as an example, where member states (including authoritarian regimes that trample on human rights) pass a disproportionate number of condemnatory resolutions against Israel, while ignoring other global crises.

* For this reason, the decisions of the international community are presented not as objective legal judgments, but as a political lynching of an anti-Israel **"automatic majority"**, which is therefore not considered binding, but rather to be rejected.

Political Reality: The American Veto

All these legal and moral arguments would be less effective in practice without the hard geopolitical power behind them. Israel can also afford to ignore binding UN Security Council resolutions or International Court of Justice (ICJ) rulings because **the United States has vetoed almost all tough resolutions in the Security Council that involve sanctions or coercive measures for decades**.

This diplomatic umbrella creates the practical situation that violations of international law have no real, tangible consequences for Israel – which from the outside really gives the impression that the country is above international law.
