July 3, 2026, Brussels, Belgium / The Hague, Netherlands – The Hind Rajab Foundation (HRF) has filed a criminal complaint in the Netherlands against two members of the Knesset, Ram Ben Barak and Moshe Solomon, on charges of incitement to genocide. The complaint coincides with the politicians’ planned participation in the 33rd annual session of the OSCE Parliamentary Assembly in The Hague, Netherlands, from 4 to 8 July 2026.

The HRF investigation alleges that both politicians abused their positions to publicly advocate policies aimed at the physical destruction and permanent displacement of the Palestinian population of Gaza. Given that more than 73,000 Palestinians have been killed and nearly 80% of Gaza’s infrastructure has been destroyed since October 2023, HRF argues that their rhetoric may fall short of the concept of direct and public incitement to genocide under international law.

Ram Ben Barak: Calling for the dissolution of the Palestinian group

Ram Ben Barak, a member of the Knesset Foreign Affairs and Defense Committee and head of Israel’s OSCE delegation, promotes „voluntary migration” of Palestinians from Gaza. In November 2023, Ben Barak proposed distributing Gaza’s population among more than 100 countries, stating, „If each country takes in 20,000 people… it would be better to be a refugee in Canada than in Gaza.”

Despite later claiming to have been misunderstood, he continued to frame mass displacement as a solution, effectively arguing to prevent the Palestinian group from regrouping in Gaza. HRF stresses that supporting such a proposal meets the legal definition of forcible displacement, which constitutes an act of genocide if the aim is to destroy a group in whole or in part.

Ben Barak knows that the people of Gaza have no real choice but to stay: water and electricity have been cut off, the Israeli blockade has caused famine, the population has been and is subject to constant attacks, and thousands of civilians have already been killed. By proposing „voluntary” resettlement under these circumstances and calling for the dispersal of Palestinians to over 100 countries, Ben Barak is explicitly promoting the dissolution of the Palestinian national group in Gaza, preventing its reorganisation and survival.

Moshe Solomon: Advocating the occupation and demographic eradication of Gaza

Moshe Solomon, a figure in the Religious Zionist Party, has been targeted for his advocacy of the re-establishment of illegal settlements in Gaza. By insisting that Israel’s security requires permanent Jewish control over Gaza and rejecting Palestinian autonomy, Solomon argues for a demographic transformation that can only be achieved through the continued killing and displacement of Palestinians. Solomon has maintained this position even during ceasefires, after international bodies, including the International Court of Justice (ICJ) and the International Criminal Court (ICC), recognized the genocidal nature of Israel’s campaign.

Growing consensus on Israel's genocide

The HRF’s complaint comes amid a growing consensus in the international legal community that Israel’s war in Gaza meets the legal threshold of genocide. This assessment includes findings by the ICJ, which has recognized the plausibility of genocide and ordered interim measures to prevent acts of genocide, as well as reports by UN bodies and experts, as well as human rights organizations such as Amnesty International, which have documented acts consistent with genocidal intent.

Accountability demands

HRF calls on the Dutch authorities to take immediate steps to hold the two individuals accountable and investigate their criminal liability for incitement to genocide.

Dyab Abou Jahjah, Director General of HRF: „The statements of Ben Barak and Solomon are not merely political opinions. They are public calls for genocide, made by officials with direct influence over state policy and military oversight. Their presence at the OSCE meeting, which is themed ‘International Law and Common Principles,’ stands in stark contrast to the atrocities they have helped legitimize.”

Natacha Bracq, Head of Litigation at HRF: „Under established international jurisprudence – including the precedents of the International Criminal Tribunal for Rwanda and the International Court of Justice – public figures of significant influence who make direct calls for the dispersal or extermination of a protected group are individually criminally responsible for incitement to genocide. Ben Barak’s explicit proposal for the worldwide relocation of Palestinians from Gaza, coupled with Solomon’s insistence on permanent settlement on Palestinian lands, which would necessitate demographic annihilation, exhaust the specific intent required for the crime of incitement to genocide.”

The Hind Rajab Foundation continues to pursue legal avenues across Europe to hold those responsible for the atrocities in Gaza accountable. This case is a critical test of whether European states are fulfilling their international legal obligations or protecting alleged perpetrators.
